1. Scope
These terms and conditions apply to the use of WichtelPilot at wichtelpilot.de. They govern the relationship between Christian Hofmann as operator and the users of the platform.
2. Scope of service
WichtelPilot provides tools to create Secret Santa rounds, invite participants and conduct a random assignment. The available features are shown on the platform. Paid services will be offered only where price, term and payment conditions are clearly displayed before the agreement is concluded.
3. Use and accounts
Organisers need a user account for certain features. Access credentials must be kept confidential. Users may use the platform only lawfully and for their own Secret Santa rounds.
4. Organiser responsibility
Anyone creating a Secret Santa round is responsible for ensuring that submitted data is accurate and that participants have been informed about the processing of their data. Participant email addresses and other data may be entered only where there is an appropriate legal basis.
5. Acceptable use
In particular, unlawful content, infringement of third-party rights, attempts at unauthorised access, bypassing technical safeguards and use that impairs operation of the platform are prohibited. The operator may temporarily suspend access where there is reasonable suspicion of misuse.
6. Availability
WichtelPilot is operated with reasonable care. However, uninterrupted or error-free availability cannot be guaranteed, particularly during maintenance, security measures or disruptions beyond the operator’s control.
7. Liability
The operator is fully liable for intent and gross negligence and for damage arising from injury to life, body or health. For slightly negligent breaches of essential contractual obligations, liability is limited to foreseeable damage typically occurring. Otherwise, liability is excluded to the extent permitted by law.
8. Termination and deletion
Use may be ended at any time. Secret Santa rounds are automatically deleted after the period defined on the platform expires. More information about processing and deletion of personal data is available in the privacy notice.
9. Changes to these terms
The operator may amend these terms where required by legal, technical or functional changes. Registered users will be notified of material changes in an appropriate form.
10. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected. If any provision of these terms is invalid, the remaining provisions remain effective.
